In conformance with the requirements of the provisions of the laws of the State of New York, these rules and regulations are designed for the protection of the lot holders and provide for the uniformity of planting that will help develop and maintain the beauty of the Cemetery and not infringe on the rights of other lot holders.
All persons shall be allowed access to the cemetery during daylight hours, observing the rules which are in effect and the propriety due the Cemetery. All funerals, processions and vehicles will be under control of the superintendent while in the cemetery. Vehicular traffic, including heavy trucking, shall be refused entrance to the cemetery when, in the opinion of the Superintendent, injury to roads and driveways may result.
All work done in the cemetery shall be done by cemetery employees or under the control or with the permission of the Superintendent or Board of Directors. The general care of the Cemetery is assumed by the Management and includes the cutting of the grass at regular intervals, the raking and cleaning of the grounds and the pruning of shrubs and trees that may be placed by the Management. The general care of the Cemetery will in no case mean the repair or replacement of any memorial, placed or erected upon the lots, that have been damaged by the elements, an act of God, thieves, vandals, malicious mischief makers or unavoidable accidents.
All lots in the Temple Hill Cemetery are sold in accordance with the provisions of the laws of the State of New York and shall not be used for any other purposes than as a burial place for dead human beings. Selection of graves will be kept within the section on the East side of the cemetery and will be controlled by the Cemetery Superintendent. Terms of payment for the lot is a check at the time the lot is selected by the purchaser. All graves are to be endowed with Permanent Maintenance Care, which is included in the purchase price of the lot. This includes the cutting of the grass at reasonable intervals and raking and cleaning of the lots. Except as provided for in Section1513(c) of the Not-For-Profit Corporation Law, no lot owner may transfer his or her lot. One monument may be placed on the grave. When the cremains are on that same grave, one additional flat marker is allowed. The standard traditional style headstone will be acceptable. The monument cannot exceed a height of 36”. All monuments and markers must be constructed of granite or bronze. No monuments or markers shall be permitted which utilize colors other than those of natural stone. A monument not of traditional style must be approved by the Temple Hill Cemetery Association (THCA).Monuments must have foundations of at least 36” in depth with a 3” border from the base of the monument. All foundations will be constructed by or under the direction of the THCA. The foundation will consist of poured concrete. The bases of all monuments shall be finished true and level so as to fit on foundations without wedging or sprawls. The foundation costs will be the responsibility of the lot owner. No monument will be allowed to be delivered in the cemetery until the foundation is installed and ready to receive the monument.
The Cemetery will be solely responsible for the planting of trees and shrubs to preserve and maintain landscape features. The Cemetery will not maintain plants or urns.No shrubs, bushes or other adornments may be placed on graves.If trees or shrubs situated on any lot will, by any means of their roots, branches, or otherwise, become detrimental to the adjacent lots, dangerous or inconvenient to persons, it will become the duty of the Cemetery Board or Cemetery Superintendent to enter said lot and remove said trees and shrubs or said parts thereof as are determined to be unsightly, dangerous or inconvenient upon due notice to the lot owner.THCA reserves the right to remove any embellishment on the lot, effigy or inscription which, in the opinion of the majority of the Board of Directors, is unsightly or dangerous upon due notice to the lot owner.No fences, hedge, post or enclosures of any kind will be allowed on graves.Two potted plants or two containers of flowers, both real and artificial, are permitted only on sides of monument. If a Shepherd’s hook is used, please place it to the left or right of the monument.The placing of votive lights, boxes, toys, ornaments, vases and similar articles upon lots is STRICTLY PROHIBITED.The placing of any glass vessels/decorations, crushed stone, wood chips or shells on graves is STRICTLY PROHIBITED. These will be removed by the Cemetery and disposed of.Decorations that have become withered, unsightly, dangerous, detrimental or diseased must be removed. The Cemetery reserves the right to remove them to maintain the best appearance of the grounds.Funeral flowers will be removed by the Cemetery, preferably within a week after the interment. Winter decorations, such as wreaths, natural or artificial, are permitted on standards or easels from November 15th to March 15th. Should you wish to save your decorations, they must be removed prior to that date.
Trash must be placed in receptacles provided. If the receptacles are full, do not throw trash on ground. (If necessary, carry out trash.)
Interments in a lot are restricted to those entitled to burial therein according to the terms of Section151.2 of the Not-For-Profit Corporation Law. Permission for burial of those not entitled to burial according to the said Section, must be filed with the THCA by the lot owner(s).
No interment shall be allowed without permission being first obtained from THCA.
When applying for permission, a Certificate of Cremation or Burial Transit Permit containing the name, age, date of birth (if known) and place of birth (if known) and dateof death along with the time and date, is required.
Lot owners are prohibited from allowing interments to be made on their lots for
compensation.
No burial will be made or monument erected until full payment of graves and burial
charges are paid.
Funerals must be at the cemetery by 4pm in order that the workmen will have sufficient time to properly close the grave and remove equipment before 5:30pm.
Interments on Sundays and Holidays will be governed by the Cemetery board Directive
2011.12 and Not-For-Profit Corporation Law 1510-b.
Interments from December 1 st . to April 15 th are allowed, weather permitting and at the discretion of the Cemetery Superintendent, in accordance with Not-For-Profit Corporation Law 1510b.
Only one full burial and one cremation burial, or two cremation burials will be permitted in each grave.
Concrete vaults or concrete grave liners are required for all full burials in graves
purchased on or after July 1, 2021, in accordance with the provisions of Cemetery
Board Directive 201.6.
Cremated remains will not be permitted to be scattered in any part of the cemetery.
The interment of cremated remains will be permitted only in appropriate rigid
receptacles such as wood, metal, plastic or concrete. Companion urns are allowed
only when they contain both cremations.
Disinterments will be allowed between April 1 st and October 1 st provided there is compliance with all the provisions of Section 1519(e) of the Not-For-Profit Corporation
Law.
Cremated remains will not be permitted to be scattered in any part of the cemetery.
Cremation Garden lot size is 36”x36”.
No more than two cremations are permitted per lot.
The interment of cremated remains will be permitted only in appropriate rigid
receptacles such as wood, metal, plastic or concrete.
Companion urns are allowed only when they contain both cremations.
No vaults are permitted in the Cremation Garden.
The plot marker must be a 1’x 2’ (one foot by two feet) made of granite and flush to the ground.
No plantings are allowed on cremation lots.
